Hello Seniors,
One of employee met with an accident during the course of employemet and died in hospital. He is not covered under ESIC.
SO Please guide me how to compesate his dependants.he was 33 years of age and drawing salary of Rs.16000 Gross PM. we also insured him under WC Policy.

Please follow as advised by Mr. R N Khola. Further call the next of kin/Nominee. Instruct the nominee to submit the details of Age/DOB Proof of the Deceased, (2) Nominee / Family Details, (3) Bank A/C Details of 1 legally wedded wife & 2 Children (if children are not available then Dependent Parents) (4) 4 Passport Photographs of each dependents, (5) Next of Kin/Legal Heir Certificate (6) FIR Copy (7) Inquest Report/Panch Nama (8) Death Certificate (if original is not available then it must be notarised).
You can claim the Compensation paid to the family through Labour Court as well as Medical expenses incurred for his treatment. You must attach further Acknowledgement given by Labour Court/Workmen Compensation Commissioner and all the original Hospital Documents.
