Dear All,
I was working with a leading MNC for last 1 year. For some personal reasons I left company in March 2011. Company accepted my resignation & I handovered company property. Till today even after 2 months from my resignation letter company has not given me relieving letter & not settled my F&F.
I requested my boss on the same but he ignored. So I complained his higher ups. My Ex boss is now angry with me & in turn has send me letter that they can not settle my claims because - 1) I have not handovered company property 2) Company suffered Hugh losses since I didn't conducted trials with one of my old customer.

Actually I have a proof with me that I have haded over all company prperty to them & there was no complaint from any customer till the time I was on company rolls. All these stories are fabricated by my Ex boss to delay me F&F claims which are merely Rs.25000/- .

PLEASE GUIDE ME WHAT SHOULD I DO??
FROM HIS LETTER SENT TO ME IT APPEARS TO ME THAT THEY ARE GOING TO SUE ME IN THE COURT.........

If your resignation is as per the terms of your appointment letter (employment contract) and your resignation letter is officially accepted by the company then company cannot sue you on any ground.
You should reply to the letter sent by your boss giving all the facts that you have resigned as per the terms of your appointment letter and that once a resignation is officially accepted, can not be rejected.
You also give documented proof that handing over was proper as per the company norms and you have not breached your employment contract.

Kamal

Just 1 query
1)As per my appointment letter - notice period is 1 month OR 1 month salary.
I have served 15 days notice period. I have a formal email from my ex boss on acceptance of the same. I have told them to deduct 15 days salary. So just want to know is it as per terms?? I am OK even if they deduct 1 month salary...

If your proposal to serve 15 days of notice period and deduction of 15 days salary was officially accepted by your ex-boss and if he was the authorized person to accept a resignation letter then now the company or your new boss can not retract from the earlier acceptance of resignation.
