Hi All,
I need a suggestion from all of you on the ESI act recovery matter.
we have a cement manufacturing company located near Silchar(Assam) about 300 km from Guwahati.In our factory we have agreement with a security agency who supply security services to our work at SILCHAR.The head office of that security agency is located at guwahati.Now we have received a letter from ESI autherity that said security agency have defulter in respect of ESI contribution for their respective employee and directed us to deposit the amount as prinicipal employer.Now we have stop his monthly bill and send a letter to security agency to clear the outstanding with ESI autherity.As in this area ESI is applicable because of Non avilbility of ESI dispensary then how the ESI authrity has directed us to deposite the amount.kindly help me what is the roll of prinicipal employer in that case.

At first instance is the duty of the principal employer to ensure proper deposit of contribution under ESI Act. and in case of default of a contractor, principal employer is liable to pay the all dues, althought the principal employer have right to recover the amount from the default contractor by way of recovery. if the ESI Act has been implimented to your area and your company is covered under ESI then ESI official have right demanded the payment of contribution.
