hi, i am rakhi, i have recieved a joining/appoint letter from a reputed company through email, with the conditions of 6 months temporary period, and one more condition is there, thai is, if i want to leave the company with 2 years, i have to pay 12 months salary to the company, and also if i want to leave the company after 3 years i have to informs in advance to company, my problem is that, all the conversions like, reciepting of appoint letter, acknowledgement of appointment letter in done through e-mail, also i have given assurance letter in written form to the company that i will able to join the company on due date, also there is a timing problem with the company. How can i get relief from this, It's a week gone that i had join the company, and presently working in it.
as there is lot of mental pressure ad physical stress, kindly advice me what i can do ?

Dear creativebit,
I feel co. is not ethical and there is some problem with it. Before joining this co. if you are under so much pressure and confusion then think what will happen after joining. I will suggest if you another job then don't join it. Terms and conditions are not reasonable. It seems offer is trap so be careful.
Regarding all docs on email. It will be wise to take hard copy of appointment letter so that there is no problem in future.
If you had already decided to not join and worry about your assurance letter then no need of worry send them one more letter that you are not coming due to XYZ reason.(If you don't want to give reason no issue) or call them that you not interested in there offer. They can't do anything.

Dear Whiteeagle, i had joined the company, a week ago, now i feel the pressure mounted on me. if there would be any legal action against me if i resigned the job.

Dear creativebit,
You are in probation period, not recd proper app. letter leave the job. There will be no action against you becoz company is also legally wrong. Most they can do is not giving you reliving letter. I believe you don't require reliving or any type of letter from them because you had just join the org. and will not show this co. exp. in your cv. Just resign from job and forget about it.
In India bonded labour is abolished and during probation period bond is not effective.

Forget about everything and focus on your current job as you've already joined (afterall you've already mentioned it is a reputed company).
Rather than posting your questions on CiteHR it would be wise to meet your HR representative and clarify your doubts regarding the joining papers, etc. Trust me, it is better to approach your HR for answers than this website which has nothing to do with your Organizations working!
Do let us know, however, the outcome of your conversation so that others can benefit if they are in the same dilemma.

Dear Rakhi,
This is a kind of bonded labour whch is not allowed in India and against the International social & ethical law.
The appointment letter issued to you itself have no legality so there is no need to be worry about organisation.
As you already joined the organisation,continue your job and try to focus on your works to become a team leader for your organisation.
whenever you feel uncomfortable or want to leave this organisation it is very easy by writing a mail/sending a notice to your organisation stating about the legality of appoinment letter and you can fight this case,becuase there is no right to challan your notice/mail by the organisation in a court,so you are free now and continue your job without tension.
Please you can take help of our NGO,we will fight your case free of cost incase there is any needs.

can u clarify me the line mentioned on my appt letter....
you will be entitled to a monthly starting remuneration of Rs 18000/-(Rupees eighteenthousand. only) which indicates cost to company. You will be on a probation period of 06 months
can i resign the company anytime or i have to complete 3 years as bonded labour, as per law appointment letter and their acknoledgement via email considered legally... in india.

An unlawful contract can not be enforced.
Such conditions as you have mentioned, do not stand the scrutiny of law. Any condition has to be just, fair and defensible in the eyes of the law.
How can you call such a company a "reputed" company ?? I think you mean "reputed" as in erstwhile Satyam.
Since it speaks volume about the philosophy and ethics of the company; you'll be better off if you can find a sutable job ASAP.
The company can not harm you in any legal way.
Monthly remuneration of Rs. 18000 CTC means just that; inclusive of everything and all perks and benefits.

Dear Rakhi,
I am totally agree with Raj. Terms and condition in your app letter are unlawful.
You can resign from job whenever you want. It's upto you whether you want to work in present co. for 1 month or 3 yrs.
