I my wife is working in software company from last 2.5yrs, there ESIC also deducted, service contract is on yearly based renew, but now he take maternity leave when 8 month started, and now company deny to extend service agreements i.e. only one month is left for expiring service agreement ,so can we still go for maternity benefit and can we get salary under maternity benefits through ESIC if service contract is not extended.

Hi, As your spouse come under the purview of ESIC, she can avail the maternity benefit through ESIC. Company not willing to renew the contract is not right. Continuance with the Company is must.

Since your spouse is entitled to maternity benefits based on her past contributions, the ESIC will provide her maternity benefits even if her service has been terminated.

She will get the benefits like 26 weeks' leave from the ESIC.

that leave should be paid or not? if paid than eisc will pay the salary, because company should not extend the service agreement.....

The leave will be paid leave. Since the leave is taken during her benefit period, it should be paid leave and it is the responsibility of the ESI to pay it irrespective of whether the employee has left the company or became out of coverage. You may contact the ESI and start availing the medical benefits now. If you visit the member portal of ESI, this entitlement will be shown there itself.

procedure to get salary from esic during maternity leave.I already 8 Month pregnancy is started & application of maternity leave is send to HR but there reply come say that they service agreement is end on 31st march-2023 and company deny to extend it.. So what to do they cant sign any document related to ESIC application like self declaration which is required for maternity benefit claim, My ESIC card valid till 30th june-2023 but still company not supported, they said that my service agreement end soon, that's why they cant do anything

There is no need to get any certificate from your HR person. You can call on the Medical Officer. He will issue a sickness report and that can be given to your HR Manager. As soon as you start your leave, the HR can mark "ESI Leave" which implies leave without pay only. The employer has no cost to incur but the ESI Corporation will pay the salary during the maternity days.

I didn't get " My ESIC card valid till 30th june-2023 ". What is that? There is no validity to an ESI card. If you have paid contribution for 80 days (at least) in the two contribution periods (of six months each) preceding your maternity leave, you should get the leave from ESIC. You can meet the Medical Officer and then give an update in this forum. Please do it asap

medical officer means which is seating in ESIC dispenser? can i tell ESIC medical officer about MY Service agreement is end on 31st march-2023 & its not extended by employer...and there is no support from company side..
