Is Moonlighting now allowed in India? Recently, in 2022, we have seen companies like Infosys allowing it with a different name as Gig job. Also, what is the current industry practice for mid-size companies with 200-500 employees?

Dear Ishita Panda,

What is the context of your query? Do you wish to do moonlighting or do you wish to take a call on whether to allow the employees of your company to do moonlighting or not?

There is no definitive answer to your query. If you wish to do moonlighting, then please take proper permission from your employer. In case, if you wish to allow your employees to do moonlighting, then hire a lawyer and design an agreement between an employer and employee. The agreement should cover points like how the secondary work should not impinge the primary work, data security, non-disclosure of information and so on.

Thanks,

Dinesh Divekar

Thank you Mr. Dinesh.
I wanted to take a call on whether to allow the employees of your company to do moonlighting or not?
So, I wanted to understand the current industry practice as Infosys allowed it recently. Also, is it a good practice? should it be encouraged/allowed?
