Dear Sir/ Madam, One of my friends was working for a small firm, XXX Technologies and while joining they took my original certificates. After joining she found out that the company is not employee-oriented and the culture is very bad, Salary was too less to survive in Bangalore. Because her family condition is not well. She worked for 2 years in the same company. Unfortunately, she went home and suffered health issues, and then she got married. Here the mistake is she informed by phone call, not by email. Regarding her resignation. After 6 months she went Bangalore office Regarding her Original documents and handed over the company laptop but the management informed her that she need to pay the amount for the laptop rent after that only they are going to discuss the original documents.
Now they are informing that need to pay nearly 60,000 to 1,00,000. After this pandemic situation, she is not able to pay even 1 rupee also it's almost 4 years completed. They found one lawyer (he is a fraud Lawyer) they discussed the certificates and she holding a company laptop which is the only thing she keeping on her side to proof of the certificates now that the fraud lawyer went to the Bangalore office and discussed there and created big issues there. The fraud lawyer informed her this month, 6th October 2022 they are going to be submitting the certificates. She paid the amount of 70,000 to the lawyer.
Now the fraud lawyer not answering calls. Now the Management side they are going to take an action against her because of the fraud lawyer created big issues in the office. Now she is loosing hope of her certificates. That fraud lawyer closed all the ways now the management informed us that we have the record of the lawyer created some nonsense in the office. Is there any way to proceed... How can she get the Original certificates?

Now there are two issues, one is to retrieve her certificates. In the circumstances explained in the query, it looks like she can only appeal to the good sense of the management and seek pardon. Can she join them back? Explore the possibility, then the issues can be sorted out amicably.
Next issue is dealing with the Advocate. I suggest making a complaint to the Bar Council of India and the Bar Association of the locality. Before that send a letter to the Advocate threatening of proceeding against him.

Your friend should had communicated through RPAD about her resignation when she is sure of not continuing... Also holding laptop for such long period also strengthening the side of employer. Instead of hiring Lawyer she could had directly requested with the employer.
Holding of original certificates is not legal on the employer. Now that the issue had worsen with multi face needs to deal the issue diplomatically. Make a apology to employer and try to get back original certificates with minimal or no money.
Do you have any proof of payment made to that Lawyer? Normally they collect cash only... Not sure how far Bar Council can support without proper proof/ records..

The employer side they are not going provid any proof regarding of the certificates. If she submit the laptop means she didn't have any proof to get back her certificate.
That is the reason for keeping the laptop.
In every conversation with the employer he was mentioning only about laptop and money. He is not even talking about certificates.
The payment mode she was done through the online itself for lawyer.

We have been trying to reach management and requesting them continously but they are not responding to her emails and phone calls .she doesn't want to continue in that company anymore.because she was the only girl in office where she is not comfortable to work with them

Always while submitting original certificates with employers we should take some acknowledgement towards number of original certificates submitted with serial number wise. Do visit the employer by person talk to HR make a polite request and ask for certificates. Please do not prolong further.
