1. Can reinstatement and relieving from services be on the same day

2. Can a composite order in one letter issuing reinstatement of the employee as well as accepting his resignation be issued although reinstatement is part of disciplinary proceedings while resignation is part of other service regulations?

Dear Rahul,

The replies to your questions are as below:

1. Theoretically yes, but please provide us with the context for both, i.e., reinstatement and relieving from the service.

2. Resignation and reinstatement from service both are independent of each other. Whether to issue composite order or club it in one letter will depend on the situation. If two letters are issued, then while issuing a second letter a reference of the previous one may be quoted.

This is a professional forum. While raising queries, it is expected that information is given in chronological sequence. One should not feel that a questioner is a boss or professor taking viva and other members are his/her subordinates or students taking the viva!

Thanks,

The reinstatement and resignation, as clarified by learned Dinesh Sir, can be issued the same day, prefereably reinstatement in the forenoon and resignation accepted w.e.f the afternoon of the same day.
In issuing a composite order, can lead to multiple interpretation that reinstatement was a farce, just to circumvent mandatory orders to this effect.
