I will complete 4 years 10 months and 25 days in a Pvt Ltd company, I asked HR am I eligible for gratuity.
He said I am not sure because we pay it to LIC, they will approve or not. My next company will not allow me to extend my joining date.

As per the prevailing case laws on the issue of completion of 5 years continuos service u/s 2-A of the Payment of Gratuity Act, 1072, the employee becomes eligible for gratuity if he completes 240 days service in the 5th year. Therefore, the employer is bound to pay gratuity in such cases.

The insurance taken u/s 4-A of the Act is only a contract between the employer and the insurer to indemnify the employer in his gratity liability as per law.

Therefore, the insurer cannot refuse and even if the insurer does so, such refusal cannot dilute the employee's right to gratuity as the employee is not a party to the contract between his employer and the insurer.
