Hi, Can anyone share the clause for termination for campus hires. In case students could not clear the graduation. Would appreciate early responses. Rgds Seema
Dear Ms Seema Rana,
Insertion of a clause on passing the last semester of the degree course is something normal. You could have written on your own also. You may write:
The company has offered you employment anticipating that you will pass all the examination(s) of your graduation completely. The sooner the result of your last semester is declared, you are required to submit the original copies of all the semesters for verification purposes. In case, if it is observed that your graduation is incomplete or if the results are withheld by your university for any reason, the company reserves the right to discontinue your employment.
In fact, this clause is not required. You can keep the freshly passed graduate under probation for 180 days. If the probationer fails to submit the mark lists of all the semesters, you can very well terminate the employment. If for some reason, the results are not declared, then you can very well extend the probation by another 180 days.
Anyway, whether you insert the clause in the appointment letter on the completion of the graduation or not, when you conduct campus interviews, you may obtain a declaration from the candidate for submitting the mark lists within 90/120 days of completion of the last semester. Take countersignature of the Dean/principal of the college/institute on the declaration. The declaration will bind the selected candidate to submit the mark list by the due date.
Thanks,
