Our registered Trade union’s Term is over on 19.01.2022 (1 year period). To date union bearer had not announced for the Union election. What is the medium from we can do further to get the election?

Is there any provision to extend election while arranging AGM - Annual General Meeting? If the Total present in AGM is less than the actual strength then it is possible to extend the election date.

What is the final way to get a union election if extension gets through AGM where the presence of employee is not having majority than actual strength?

Please guide.

Pl see the State Rules under the Trade Union Act 1926. Looks like you are from Gujarat, so look for the Gujarat Rules. There is a provision for the Trade Union Registrar to intervene. You have to formally take it up with the Trade Union Registrar complaining about the non-holding of Union election. Here I am presuming you to be a Trade Union follower, if you are from the management then do not involve yourself directly in the election process of the Union. How to deal with this issue could be discussed with more facts.

Dear Colleague,
As rightly pointed out by our Colleague in the reply what is important is the deeper detailed check by you on the Trade Unions Act 1926 and Rules made there under. On your specific questions raised the answer will not be there in the Act and Rule also but it will be BY LAWS of the Trade Union. Normally most of the Union Elections will be once in 3 years but it is purely based on how the time span is defined under BY LAWs of the Union. Hence please have a complete reading on the Trade Union By Laws to get your points clarified.

It is not clear that you are from which side. It is better to keep silent if you are from management side as suggested by seniors unless you or management have any particular interest. AGM etc. are as per byelaws of the union. So far as the election process is concerned you may look into Code of Discipline if the union affiliated to national unions.
