Good evening all, Please share the new definition of over-time in latest code on wages? How can we manage the overtime in manufacturing industry?

Dear Sohan Singh,

I think that the term 'over time work' has not been defined in any of the four Labor Codes. So far as a manufacturing establishment is concerned, section 27 of the Occupational Safety, Health and Working Conditions Code,2020 prescribes that a worker shall be paid twice the rate of wages in respect of over time work, where a worker works in an establishment or class of establishment for more than such hours of work in any day or in any week as may be prescribed by the appropriate Government and the period of over time work shall be calculated on a daily basis or weekly basis whichever is more favourable to the worker.

If we cross-check the corresponding Central Draft Rules,2020, rule 56 stipulates that when a worker works for more than 8 hours in a day OR for more than 48 hours in any week, he is entitled to wages @ TWICE his ordinary rate of wages and the same shall be paid at the end of each wage period.

I also think that it is not different from the provisions of section 59 of the existing Factories Act,1948.

Yes, the definition or regulation on overtime has not been changed all that has changed is the maximum allowed overtime hours in a quarter
