Dear Colleague,

The following items will not form part of the wage either under Section 2(9) or under Section 2(22) of the ESI Act:- ( As per website of ESIC) - Kindly refer ESIC website.

Payment made on account of un-availed leave at the time of discharge.
Commission on advertisement secured for Newspapers, if not paid to the regular employee.
Fuel allowance/Petrol allowance
Entertainment allowance
Shoes allowance
Payment made on account of gratuity on discharge/retirement.
Payment made on encashment of leave.

As per section 2(22) of ESI Act, " Wage" does not include —
(a) any contribution paid by the employer to any pension fund or provident fund, or
under this Act ;
(b) any travelling allowance or the value of any travelling concession ;
(c) any sum paid to the person employed to defray special expenses entailed on him by the nature of his employment ; or
(d) any gratuity payable on discharge ;
