Hi,We have 100 employees and everyone having more than 15000 Basic + DA and also we are not ready to pay EPFO as per my knowledge we can exempt from EPFO who were having more than 15000 basic+DA please let me know and also send me form-11 exempt declaration from the employee.

Employer has no option to declare any employee as EXCLUDED EMPLOYEE on such wordings that employee does not want to participate in welfare contributions.
if the employee has any past history with EPFO, or has active UAN, then he/she can not be excluded in any case, but has to continue membership at all salary levels
so it is necessary documentation as form 11(EPFO), along-with KYC details where the employee declares about his/ her details and declaration about previous relations with provident fund.
if the employee does not want to participate in EPFO contribution, he may apply to HR of establishment along-with form11 submission to make him/her excluded, in writing, after which the HR may check the criteria on the basis of form 11 and KYC submitted, whether the "excluded employee" definition may be applied on employee or not.
in normal practice, the employer has to offer uniform EPF membership to all employees, irrespective of their basic, however the employer has option in hand to fix the ceiling level to max 15000/-

I understand that the organisation has not yet registered under EPF...Act though the number of employees is 100 with the impression that everyone is having salary above Rs 15000. If so, first of all register the organisation under EPF. The registration would take place with a retrospective date, ie, the date on which your employees strength became 20. If that happened to be a date prior to Sept 2014, then for coverage you would have to take all employees whose salary did not exceed Rs 6500. Since an employee once covered would continue to be covered even after his salary exceeds the threshold limit (ie, Rs 6500 then and Rs 15000 now) they would continue to be covered.
In respect of new joinees you can apply the principle of No PF if salary exceeds Rs 15000.

What is the new rule for EPFO exemption for employees if they having more than Rs.15000. I came to know that irrespective of 15000/- ceiling limit, all the employees in the firm should cover under PF but with a ceiling limit of Rs 15000/-.
Say for example,
If an employee is getting salary of Rs 25000, He/ She should consider for PF calculation with a limit of Rs 15000/-.

If at the time of joining the company, the salary (P qualifying salary) is more than Rs 15000, you can exclude him from P. However, if he was a member of PF in his earlier company and the same remains active, then he should be given coverage in your company also with a ceiling of Rs 15000 for contribution.

Once enrolled as a member of Provident Fund he will continue to be a member even if his PF qualifying salary exceeds Rs 15000. Therefore, if his salary becomes Rs 16000, he will continue to be a PF member and contribution at least on Rs 15000 should be made in respect of him.

Some of our employees P F is being paid on actual basic , ie more than 15000/, now we would like to restrict it on 15000/ and the differential amount of above Rs 15000/ shall be credited to the bank account of the respective EPF members with monthly salary, instead of depositing the same in EPFO
Please let us know whether we can it do or not
