Imparting education cannot be equated with any industrial or economic activity and as such a teacher cannot be a workman though education is an industry is the current judicial thinking. Therefore, teachers employed in unaided private schools will not come under the purview of the Minimum Wages Act,1948. Of course, the service conditions including salary of those teachers working in State Government-aided Private Schools can be regulated by the States by appropriate legislation. Better check with the School Education Department of your State.
