I have put down papers in my current company owning to my health conditions (severe diabetic) and family issues and i have to take immediate decisions to avoid divorce notice from my wife. I am trying to relocate to a different place so that i can avoid the internal family violence and take care of my health as well. However the company HR responded that notice period is 90 days, i am trying for jobs in other states informing 30 days is my notice period. What should i do now if the HR is not allowing to leave early than 90 days?

Dear Srsr8004,

You wish to have a notice period of 30 days however, your company says it is 90 days. Differing views on the notice period apart, the question arises is what terms are mentioned in the letter of appointment? You need to abide with that.

Irrespective of the length of the notice period, have you submitted proper letter of resignation? If yes, then if the appointment letter says to serve notice of 90 days then put up application to the MD of your company to curtail down the notice period.

While asking for the reduction of the notice period, make sure that it is based on the cogent grounds. Therefore, provide material evidence wherever possible.

You have written that "i have to take immediate decisions to avoid divorce notice from my wife". Has the marital discord arisen because of your employment? By quitting employment, will the marital strife be avoided?

I understand the condition through which you are passing through. Nevertheless, your perplexed state of mind should not have a bearing on your convincing skills. While talking with MD, you should speak in sequence and it should be to the point.

In the offer letter it is mentioned as You are required to give us a written notice 90 days in advance in case you wish to terminate your employment with organization

I have sent the formal letter of resignation and the HR has accepted it as well. However they are asking to serve 90 days notice period as per company policy. My reporting manager knows all the issues i am facing right now and he is ready to relieve in shorter notice period but the HRs are clear in their grounds as it is company policy. I have all medical records in terms of medicines i am taking right now and the lab reports.

Finally the marital discord is due to the fight between my family members and my wife side family members due to the ego clashes. If we move to a different state i can reduce the daily contacts of all family members and reduce the heat of daily conversations which will help to avoid the situation of divorce.

I will try approaching the MD and see if he can help and stick to the points.

Dear Srsr8004,

Whatever the domestic issues you may have, if your appoint letter (not the "offer letter") has a exit clause with 90-day notice period then you need to fulfil that clause. This will help you in getting an unblemished relieving letter. If you abandon the employment then possibly you may not get the relieving letter. Please note not to get engrossed in the domestic affairs so much that it could harm your career itself.

As stated in the earlier post, I recommend you asking for the interview with the MD for the early exit.

Lastly, my comments on the last paragraph. Though this paragraph is out of purview of HR Management, let me suggest exploring the possibility of a separation from the family members of both the sides. Will your stay in the rented accommodation mitigate the strife in the family?

I have not received any appointment letter the offer letter is what issued by HR when i joined the organization. (The letter starts with We are please to offer you the position of Analyst). In that letter it was also mentioned as "You will be on probation for 6 months and your postion in the company will be confirmed after the probation period". I have received only that one letter in written in which it was mentioned the notice period clause i mentioned in my past thread. I joined the organization on Oct'19
The HR sent me an email on Aug 13th 2020 that i am a confirmed employeed in the Organization and informed that written document will be issued once we resume back to office after Covid-19 pandemic is over.
Yesterday, I tried to reach HR personally and thought of sharing the situation but he is not ready to listen and stating that we cannot run company if we give excuses for each employee. So i am planning to talk to my reporting manager one more time before i talk to my CTO who manages operation. Then will have to take it to my CEO with all medical records.
Thanks for your personal suggestion on the last para. We had plans to move out of our own house and stay in rental but my father is a senior citizen and my mother is a bed ridden owing to septic shock with mods. If we are going to stay out in a rental house i have to visit back again and again because they need health care support and it will create more harassment talks. I am not explaining all the issues in detail here but i have tried all options to avoid taking this last step of moving to different town or state. If we move a different town or state due to work my parents will definitely move and stay with my brother who is in different town in rental house.
