Hello all,
Company is going to close India operations and told after 3 months it will last working date, And employee got opportunity of offer if willing to join early with other company, but current employer is not willing to let go of him and asking him to serve notice periods of those 3 months and because of that employee lost that opportunity.
Because of that depression he didn’t work for 4 days and now company is saying they will terminate him,because he didn’t work 4 days.
And they didn’t give him any signal warning also
Please suggest what employee can do in this situation.

My suggestions are,
In the circumstances explained, If you have documents to prove your averments, especially w.r.t. their advance notice of closure and consequent retrenchment being facts which could substantiated, you should try to issue a legal notice of early relief to enable you to seek alternate employment elsewhere highlightinh the closure. May be you should be prepared to compensate by cash equivalent.
Reg. your 4 days absence, does't cover the lock down period ? If it is in other than 'lockdown' period then you'll have to manage either to convert it to leave with pay or without pay. Absenteeism during 'notice period' normally is not permitted. You have to find ways to justify.
