Dear Sir/Madam,

Please clarify

1. Does earning monthly wages indicate GROSS WAGES in Pradhan Mantri Garib Kalyan Yojana (PMGKY) Scheme.

[OR]

2. Does earning monthly wages indicate EPF/EPS WAGES in Pradhan Mantri Garib Kalyan Yojana (PMGKY) Scheme.

3.Whether an employee who is earning monthly GROSS WAGES more than Rs.15000/- but earning monthly EPF/EPS WAGES less than Rs.15000/- employed in an eligible establishment, is eligible for Central Govt. relief under Pradhan Mantri Garib Kalyan Yojana (PMGKY) Scheme.

Kindly clarify

Please find the below things and guide us

(1) Please see the Serial Number 2,3 and 5 in that attached ECR. In that Serial Number, Employee who is earning monthly GROSS WAGES more than Rs.15000/- but earning monthly EPF/EPS WAGES less than Rs.15000/- employed in an eligible establishment, System gives eligible to them for Central Govt. relief under Pradhan Mantri Garib Kalyan Yojana (PMGKY) Scheme.

Is this correct sir.

(2) Please find the Point "C" in that enclosed facebook image. EPFO RO Vadodara (https://www.facebook.com/epfrovadoda...28547535479561) has used the sentence as Employee who is earning EPF/EPS wages less than 15,000 is eligible for PMGKY.

Is this correct sir.

(3) Please find the attached Screenshot.

In attached PMGKY Scheme CERTIFICATE AND DECLARATION screenshot (Underlined by Green Colour), Government has used the sentence as follows:

"earned EPF/EPS wages less than Rs.15,000/- qualifying for Central Govt. relief."

As per above said sentence, Employee who is earning monthly EPF/EPS wages less than 15,000/- employed in an eligible establishment, he is eligible for Central Govt. relief under Pradhan Mantri Garib Kalyan Yojana (PMGKY) Scheme.

Is this correct sir.

(4) Please find the attached PMGKY Benefit Not Given Remarks :-

Reason Code: GK10001

Reason Name: EPF wages are greatter than or equal to 15,000/-

Employee who is earning monthly EPF/EPS wages are greater than or equal to 15,000/- employed in an eligible establishment, System will not give eligible to them for Central Govt. relief under Pradhan Mantri Garib Kalyan Yojana (PMGKY) Scheme.

Here, EPFO does not talk about Gross Wages. Which means Gross wages doesn't matter for eligibility criteria for PMGKY.

So,

(i) Employee who is earning monthly GROSS WAGES more than Rs.15000/- but earning monthly EPF/EPS WAGES less than Rs.15000/- employed in an eligible establishment, he is eligible for Central Govt. relief under Pradhan Mantri Garib Kalyan Yojana (PMGKY) Scheme.

(ii) Employee who is earning monthly EPF/EPS wages less than 15,000/- employed in an eligible establishment, he is eligible for Central Govt. relief under Pradhan Mantri Garib Kalyan Yojana (PMGKY) Scheme.

Is this correct sir.

This is a grey area even for the EPF Organisation. I was with the impression that salary for all purposes should be PF qualifying salary. But I came to know that it is gross salary and not PF salary. The government has been issuing so many circulars just to cover the stimulus package of 20 lakhs crores. This is also part of it. Therefore, I cannot comment on it.

EPFO Official Answer is as follows:
Answer:
In the Scheme for PMGKY the declaration part stated that the EPF/EPS wages should not be more that 14999 that is it should be less than 15000 for the eligibility.
You must have filed the declaration and there it is clearly mentioned.
The eligibility is based on EPF/EPS wages that should be less than 15000.
Answer for Q3: Yes, s/he will be eligible as PMGKY scheme considers only EPF/EPS wages. PMGKY benefit will be decided by EPF/EPS wages and not Gross Wages.

Dear Friend,
As of now whatever law are in force or in process of amendment are less focused to the workmen than to meet the need of industrial or business houses. We can notice black patches in almost all in spite of laws and rules existing. In minimum wage component hardly there are numbers whose basic would be more than 15000 bucks and gross wages consisting of over time which does not attract PF but attracts ESI up to 21000. This gross wages are not a perennial income rather irregular. The business and industrial houses have got nothing to do with PMGKY and we should not fall in between.

Dear Sir,
I have a query, One of my employee whose gross salary is 22000 and EPF salary is 15400 and so he must be ineligible for PMGKY Scheme. But since he was only present (Contributory days) in June, 2020 for 10 days hence the EPF salary is way below 15000 now & when i am uploading ECR, it automatically gives PMGKY benefit to him although i think he is not eligible for the benefit.
What is the solution for the above problem because in July month he is present for full days and his Gross & EPF salary both will be above Rs. 15000. So can an employee becomes eligible for one month & then becomes ineligible for another month. Is it correct?

In all matters it should be the notional wages and not the earned wages that should be considered. In this case also, there was an error in capturing the figures. had the system taken the number of days worked also, the confusion should not have come.
