Hi Everyone
I am currently employed in TCS and deputed to Japan for an onsite assignment. I want to resign the company due to some personal commitments. Before coming to onsite I have signed a service agreement which states “On return to offshore I am bound to serve minimum of 3 months in India”. In case if I violate this I am liable to pay an amount not exceeding Rs.5,00,000/-.
1. I want to know whether the above mentioned 3 months are same as the general 3 months notice period?
Also the service agreement mentioned above quoted amount would be in addition to USD 30,000 payable by me as liquidated damages as set in overseas agreement policy.
2. Can anyone explain me regarding USD 30,000. Under what circumstances I am liable to pay this amount. I do not have any copy of Overseas Agreement policy with me.
Warm Regards
