We have faced a problem where employee resigned immediately after joining back from maternity leaves.
Can we write it in our policy that employee has to serve a minimum duration in the company after joining back from the maternity leaves otherwise she will be liable to compensate the balance period from her basic pay .

Hi Aarti,
I assume you must have notice period policy, where employee has to serve notice period while resigning, if not then implement it.
Many companies have policy for payment of notice period, by either party.
Making / changing policy is totally your company call.

No. It will be against law to require a female employee to remain in your service even though she has already had the benefits just because the benefits she had from you are available to her as accrued. An amount accrued should be paid to the beneficiary and the amount so paid cannot be recovered.
