Recently my brother died in an accident. At that time he was working in a private organization. Employer mentioned his last working day as 12th July (Friday) but the incident happened on 14th July (Sunday). Saturday & Sunday are a week off. Will it impact on benefits like pension to my parents and what are the benefits will be provided by EPF to my parents as the nominee.

Dear Mr. Skaetesathyan, You have not mentioned, how many years your brother has worked before his death. As per my knowledge he will entitle for pension. Sanjay Tiwari

Epf benefits are
1)epf contribution.
2)eps contribution
3) edli contribution.
Entitlement criteria.
1)Needs more than one month for epf.
2)needs more than 180 days and if <10 yrs services to withdraw.
For >10yrs the mployee entitled for pension.
3)In case of death - edli benefits is entitled.

Since the date of exit from PF is two days before the death, you will have to do a lot of paper work to get pension. The nominee will get pension, EPF accumulation and EDLI. But the employer has either purposefully or due to oversight done a mistake by showing last working day as 12th July. The employer should have put the date of death as exit date. By putting two days earlier date it will be presumed that he had left the company. Due to this the legal representatives will not get EDLI amount which would amount to around Rs 6 lakhs depending upon his service. You may please contact the employer and also the EPF Office and try to correct the date of exit first and then start processing the pension papers. Other than EDLI, any way, he will be eligible to get pension and PF.
