Kindly suggest whether Maternity Leave is applicable even for an employee who is not covered under ESI and whose salary is above Rs.21,000/- if it is applicable then for how many months she is eligible for maternity leave.

For claiming maternity benefit which is a leave benefit with wages and continuity of service, salary is not at all a criterion but a minimum service of 80 days in the establishment during the preceding 12 months prior to the expected date of delivery is required. This leave comprises of 26 weeks in total of which 8 weeks can be availed of prior to the day of delivery and remaining 18 weeks after delivery or at a stretch of entire 26 weeks from the day of delivery.
