I have been working in an e-commerce organisation since last 6 months as Manager Operations.
They gave me only offer letter, till date they didn't even gave me appointment letter. Am having all the payslips (Oct'19 as well)
My Oct'19 salary they kept on hold and yesterday on-wards they are saying that if you resign job then only we will release your salary, otherwise we will terminate you.
I asked them for 3 months notice period, but he (CFO) denied and said only 1 month we will give but that 1 month also he is not ready to give me in written communication.
I wrote a mail regarding my Oct'19 salary on 2nd Nov'19 by putting all HR's and VP, CEO & CFO. But no one responded to my e-mail! After my followup mail CFO called me and forced me to resign (3rd & 4th para conversation happened between us).
I have recorded our conversation with CFO.
Please suggest me shall i get 3 months notice period pay or only 1 month pay???
What our Labour Law saying about this...If they terminate me what course of action i need to take furthur.

If you are a Manager and on probation, accept the one month notice pay and get relieved immediately because no Labour Law will help you. It is okay if there is no probation clause but you are a confirmed employee and your contract of employment says that notice period is three months. In such case also, the remedy is to file a case for breach of Contract. This being a civil case will take its won time to come up for hearing and reach a settlement. Therefore, it is good if you leave in good terms. If provoked, you may find it difficult to get a favourable reference from this company.
