Dear All, Can you please share if any circular /Notification regarding non-coverage of new employees (including IW) under EPS, if their monthly salary is more than Rs.15000/-

if the establishment is covered under EPF then they have to offer all labor welfare facilities in uniform practice to all employees
but
if the employee
1) does not have any active UAN or membership from past service/s
2) do not want to participate in EPF
then they have to submit form 11 with a request letter of their option of not participating in EPF, employer has no choice to exclude or include
also if the member has any past record of EPF relations, then he would not get exemption from contributions
but
if the employee

As per EPF Scheme, Para 69, (5) - Any member who withdraws the amount due to him under subparagraph (2) shall, on obtaining re-employment in a [factory or other establishment] to which the Scheme applies, be required to qualify again for the membership of the Fund and on qualifying for membership shall be treated as a fresh member thereof.

Thanks for your response. But I want information about EPS. I am told that in case of new employee whose salary is more than Rs.15000/-"should be" exempted from EPS. Request you to kindly clarify. It is more helpful if you can attach circular,if any, on this issue.
