Before giving a direct answer to your query, I would like to request you to go through the provisions of sections 51,54,55 and 56 of the Factories Act,1948 dealing with weekly working hours, daily working hours, intervals for rest and spread over respectively.
Since daily working hours and intervals for rest together form parts of the spread over of work, rest hours are exclusive of the weekly working hours for the term "spread over", though not defined under the Act, would mean the total hours the worker is under the actual disposal of the employer.

Rest hour and working hours are different. Normal working hours in a factory is from 8 am to 5.00pm or 5.30 pm. Actual working hours in a factory per day is 8 hours in a day or 48 hours in a week. (that means factory's duty/working hours is from 8 am - 4 pm-which constitutes 8 hours period). However, workers are eligible for break after putting in requisite period of work towards tea break and lunch break. Hence it is correct to say that rest hour or break is excluded from working hours. However, all employees who from the date of entering into factory, till their exit from the main gate of factory is under the control of his employer.
