What is the minimum timeframe to compensate an employee's salary whose employment is being terminated on the grounds of poor performance?
As far I know, if management is giving sufficient time to their employee to perform, conveying verbally several times to improve their performance, then in such cases what is the right to give FNF to the employee- after 45 days or at the next payable day or at the same time? Because management is giving sufficient time to perform and also intimating them, then now we can't say its a on the spot termination.

As per standing acts, you can't terminate an employee on the spot. You will need documentation that the employee's performance is low and moved the non-performer to performance improvement plan. Employee needs to confirm that his performance is low and as agreed to participate in the pip program for his improvement. The employee is given proper training and a new KRA to achieve, failing which the company can terminate him. The employer can pay severance package against his notice period if the company doesn't want him to serve.
