My query is if a female employee joins the organization when she is two months pregnant . Is she is liable for maternity benefit act? As she knows before joining the new company that she is pregnant. Pls help to understand the same.

One need to refer to the Act to get a fair idea of basic rules.
Maternity benefits act provides certain benefits under certain conditions to women employees.
If a lady employees has worked for 80 days, she becomes entitled for Maternity Benefits.
Joining a company when she is pregnant does not disentitle her from receiving Maternity Benefits subsequently.

If the Establishment is not covered under ESI Act. Every woman employee, whether employed directly or through a contractor, who has actually worked in the establishment for a period of at least 80 days during the 12 months immediately preceding the date of her expected delivery, is entitled to receive maternity benefit.
Whereas in ESI covered establishments, any women employee who has a payment of contribution for 70 days in one or two consecutive periods is eligible for ESI maternity benefit.
