Dear All, Kindly help me with my querry I have been terminated from co X on the ground that I had an affair with my colleague in the office. The same colleague had raisedthe sexual harrassment case against me. After the investigation which lasted for seven months the commitee came to conclusion that the case of sexual harrassment was not proved, but the cited that I had misued my position as the head. They suggested stern action against the complainant (the colleague), and and equally stern action against me.
Both of us were terminated from the services. I have also recieved my full and final settlement, as per the termination letter it says act of indicipline (under the clause of appointment letter).
Now I want to join another company can I join without the reliving letter. Or Should i join some other company without telling them about the company X,
Will the new company come to know about my pevious employment details on the basis of PAN and AAdhaar.
Is there any way out. Need your assistance.
Lindly give the right answers from HR perspective as the role of HR starts post joining.
Q1 I need to hide my UAN?
Q2 Will the new company know my employment details?
(as i am planning to change my CV and remove the experience of Company X, and replace it with my own business)
In case of any supporting that can be shared on one to one basis.

Do you have any other choice? you know what you have to do to get your life back on track as you have already analyzed all the options. But know this, once you lied you have to stick with it till end. Future company may ask you for relieving and last salary slip. Please beware of making such mistakes again in future. All the best. If nothing works, You can go for your own startup.

But my questions remained unanswered. Does company go checking details with EPFO in case of my earlier UAN number comes out because of pAn and Aadhaar

Dear Sir,
Don't worry !!!
Focus on your new job instead of thinking back on your past. nothing will happen. If you are ready to start new innings with new hope than nothing will happen.Do not repeat the same mistake again.
In back ground process check process most of the companies are sending an email to previous organizations for verification or they hiring agencies to know criminal back ground if any.They will not approach through PF and all.

You need not worry .there is nothing to do with EPFO & ESIC for background check.One thing you have to keep in mind that EPFO and ESIC are linked to aadhar no and you can not hide your employment tenure with busines as when you will start with new opening with other company with EPFO coverage your aadhar will tell about your previous linkage with Ex employer.so do not hide and contact with your ex company and look out for ammicable way by which you can get relieving letter.In cases like yours employers always asks for resignations as termination creates certain rights for employees in court of law detrimental for companies.

Dear Sir,
In your case I would suggest that you stick to "Honesty is the best policy".Be open with your new employer and am sure they would appreciate your Honesty. As such you have been exonerated from the sexual harassment case, So why worry. Please remember lies are always caught. Avoid any kind of flirting with Office colleagues.
