My cousin got into trouble? My cousin gave his resignation to the company after 15 months of employment due to some inappropriate approach of the company. But company was not willing to relieve him. In the meantime, he got a job in another reputed company and joined the new company.
He made a fake experience certificate and produced to the MNC. They did a background verification and he get caught. MNC company just told him to get the certificate and resume his work. But the company which he worked for earlier got to know this and they lodged a police complaint.
He went and talked to the company people and inspector. He even gave an apology letter as per DSP instructions. Actually the police is not ready to file FIR since he gave apology. But the company people want to punish him and show this as an example to other employees in the company. They also didn't hand over his original certificate. Can anyone please help me to understand the severity and what he has to do to escape from this.

First take out the Appointment letter which the company gave you and try to see if there is any point mentioned regarding the due process of resignation. If yes, then go according to that or talk to some good legal person who has knowledge of this type of cases.

He made an experience certificate and produced to the MNC. - Its crime as per Indian Law
They did a background verification and he get caught. MNC company just told him to get the certificate and resume his work.
But the company which he worked got to know this and they lodged a police complaint. He went and talked to the company people and inspector. And he even gave an apology letter as per DSP instructions. Actually the police is not ready to file FIR since he gave apology. But the company people want to punish him and show this as an example to other employees in the company - For relieving letter, he may approach Local Labour Office through them he "may" get relieving letter
They also didn't hand over his original certificate. - Why did he submit his original certificates?
Canyone please help me to understand the severity and what he has to do to escape from this - Sincere apology to Owner of Company/ Head of Company can help you out of this situation

Severity of the act is critical to your cousin’s career. The best way to escape is to settle things amicably with the previous employer so that they handover the certificates as well.
