Workers covered by minimum wages act. Salary structure would be as prescribed. If extra paid it would be on different head!

Dear colleague,
To the best of my knowledge, there is no law or any guidelines for salary break up in private sector from govt.
Minimum wages Act of almost each State govt does provide for basic and special allowance { D.A.}. Pl check for your state and follow them.

Dear Sunil,
The Govt. has to fix and revise Minimum Wages as per classification of Industries every six months i.e. January to June, April to Sept. and October to March, which is known as Basic and Special Allowance (D.A.). You can pay anything more in different head as per your wish as an Other Allowance/s.
For example if you are paying INR 20,000/- per month to Accounts Clerk and the Minimum Wages (Basic+DA) is INR 10,000/-, you can split the break up as under (Keeping in mind Tax Savings):
Basic Rs. 8,000 (or as per MW)
Special Allow. Rs. 2,000 (or as per MW)
HRA Rs. 4,000
Med. Reimbursement Rs. 1,250 (Tax Exem.)
Conveyance Rs. 1,600 (Tax Exem.)
Tel./Mobile Rs. 1,750
Other Allow.(LTA) Rs. 1,400

T O T A L Rs.20,000

(Basic and Special Allowance you can club together and show as Basic only, but ensure that it should be always more than the MW).
Pls check under which scheduled employment your industry is falling, accordingly pay their Basic and D. A. and remaining part pay as Special Allowance.
For better understanding I am forwarding in attached file Maharashtra Minimum Wages for the period from Jan. 2018 to June 2018 for different Scheduled Employment for Un-skilled, Semi-skilled and Skilled category-wise employees.
You are required to check what is the MW payable for your industry according to Classification of Industries and split the salary break up. No law will stop you doing that.
