one of the employee have quited without any prior intimation and notice period but he doesnt want any of his work experience certificate so what action could we take from our side for not informing prior.

Dear Suhan, you have not mentioned about Termination Clause as mentioned in the Appointment letter.you may initiate action accordingly

You can act according to the offer letter. But best is ignore and carry on. You will get another candidate and work will not get hampered. It is a waste of time to initiate legal proceedings.

If the terms of appointment indicates one month or three month notice from either side and if the employee has quit without giving any notice, under the provisions of Standing Orders you can file a suit for recovering the money as liquidated damages but the procedure is cumbersome and time consuming.Hence, as suggested above forget and employ a new candidate.
