Hello Everyone, Please help me out, is new employee is applicable for maternity leave (for Mumbai & Maharashtra) and how many days is applicable for her. She is in her probation period and she has applied for maternity leave. At the time of joining she has not informed about this. She has worked for 3 Months.
Please give me solution what should i do.

The Maternity Benefit (Amendment) Act 2016, passed by the Rajya Sabha in August 2016, has also been passed by the Lok Sabha in March 2017.
Also the Act further requires an employer to inform a woman worker of her rights under the Act at the time of her appointment. The information must be given in writing and in electronic form (email).
The lady employee is entitled for maternity leave.

Dear Ankit, Yes she is entitled for Maternity Leave as per new amendment of 182 days leave. If she has worked for continuous 80 days in the organisation.

Hello Manoj, 80 days as per ESIC Act. What is the minimum working days under S&E act for mumbai.
