I'm working in a PSB not yet confirmed and I'm under probation. Recently I got offer from another co. For Which im willing to move. At the time of joining I was made to deposit an security fund , which will be forfeited if I resign / got terminated during probation. Later Upon my resignation my employer insisting me to render notice period of 3 months along with forfeiture of security fund which was not clearly mentioned at any where in my appointment letter.
1. Whether an employee is supposed to serve notice even before confirmation/ in probation?
2. Does compliance of notice period along with forfeiture of fund are permissible under Indian Labour laws?
3.If at all an security fund is initiated why should an employee supposed to serve notice period again?
Kindly suggest suitable answers...

Please read your offer letter twice. If nothing is mentioned regarding notice period while probation you need not serve. Please talk to HR regarding the same and tell him that you are unable to serve notice and ready to compromise your security deposit. are you a manager or workmen?
