Dear Seniors,
I want to know the probation period extension limit . for how long we can engage a executive on probation. Or either we can engage a person for more than 3 year on probation on the basis of his performance.
Need your inputs on the above topic.

## Under section 2 of the Model Standing Order, probation period is usually 6 months however it can be extended by a by a period of three months at a time at the discretion of management. The maximum probation period can't exceed two years. A person is employed as a probationer generally to fill a permanent vacancy in a post. If a permanent employee is employed as a probationer in a new post he may, at any time during the probationary period, be reverted to his old permanent post.
But,There is no law determining the length of a probationary period.It is typical for a probationary period to last no longer than six months, and three months where an employee is moving to a new post internally.
Note: Subject to Organization's Standing Order.

As per the act probation period is of 3 months. There is provision to extend it by other three months. That's all.
Probation period is for both, employee & employer to know the compatibility; you need to judge employee performance within six months. If it is not suitable, the relationship should be ended. If such employee approaches labour department alleging harassment, you will be in trouble.

If the person is not performing as per the norms in the probation period and after a subsequent one extension, then we should part ways amicably. But the employee should be informed about his progress in writing. Also, why 2 years are needed to check, if the person is performing... The feedback and evaluation process also needs to be checked... There is a flaw, if a person needs to prove himself for 2 years... thats a very long period...
