Dear Seniors, Good Day
I have been working in a automobile Firm in Kerala , recently one of our previous employee came fore a exp certificate for submitting PSC, he is asking for 10 yrs old mustroll ,wage register copies etc . we don't have 10 yrs old documents .... .. there is any time limit for keeping all this records in labour law? please advice ...

According to the income tax act company need to keep last 8 years of data in there record as a compliance.beside if any legal proceeding is going in the court of the law then organisation will have to keep all the required data of years. further wages act says for last 3 years to be kept.Under Minimum Wages Act,1948 an inspector can demand registers & records for a period of last three years
seniors kindly correct if i am wrong.

To the best of my knowledge and understanding, there is no provision in any Labour Law prescribing time limit for preservation of records by an employer. Of course there is specific provision in certain Labour Laws prescribing time limits for the preservation of records such as counterfoils of licences issued, orders of exemptions granted, files relating to claims disposed by the respective authorities appointed under those Acts and their destruction thereafter. Normally, registers and other records pertaining to a particular year may be preserved by the employer for a period of 7 or 8 years and in case of documents involved in any dispute might be kept intact till its final disposal. The further views of learned members are solicited with citations,if any.
