I had been working in a private bank. I had put my resignation from Private bank but could not serve the mandatory notice period of 90 days due to I got job in PSU in good post and they don't seek any relieving and experience letter from my previous employer and even they don't allow me to give any extension in joining . I told all supervisors that due my father's illness I will no be able to continue my job showed them medical papers also as per their demand.

Later on my current employee had verification call with my previous bank. Now my HR is very furious and telling me that either I'll be absconded or will be treated as VOLUNTARY ABANDONMENT OF SERVICE... Please suggest me what shall I do? My resignation has been approved by all supervisor but now it is with my HR... CAN I GET relieving letter and experience both?

Dear Friend,
You don't worry. As per terms and conditions of your appointment letter there should be a clause related to 90 days notice period or pay salary in lieu of 90 days. You can request them to wave off 90 days notice period as a special case viewing your contribution and time frame of service in the organization (if they consider) otherwise you can pay the 90 days salary amount in lieu of notice period and get the immediate relieving.

1. Why you thought of lying, you were not doing anything wrong?
2. Have you given written resignation to HR? Do you have acknowledged copy, if yes, do not bother just be ready to pay for notice period.

Yes I have given written resignation and in the system both also intimated them through mail having all copies with me. now HR made all the settlement payment for non serving of notice period. But now HR is telling me that they have clear decision to issue Voluntary Abandonment of service certificate that will be mentioned in experience certificate. Kindly advise me in future this experience will count?
What would be the bad effects that I would face in future if I apply for any job in future and I give experience?

1. HR is trying to bully you. Write them a mail with cc to your HOD,HR Head & your CEO.

2. Mention in the mail the exit clause from your appointment letter. Also mention that in accordance with the appointment order you are paying for the balance period and I have sincerely worked for the part notice period, specifically mention that the so and so person from HR has told you that they have clear instructions to recover payment in lieu of not served notice period and issue a letter of abandonment.

3. Mention that if this is what HR is going to do then I will have resort to legal action.

4. Contact some good advocate who deals in service matters and consult him.

5. First you speak directly to the HR head & record the conversation, explain to him every thing and if he also behaves in the similar manner, tell him that you will go legal.

6. If the company still do not behave properly, they will face problem.

7. How long you have worked in this company? if period is long, then matter has to be tackled differently.

7. It may not have significant effect on the future life if you have all the documents to support your version.
