In my manufacturing company many employees are not ready to deduct the EPF portion as well as company is convincing to not deduct the epf those employee whose salary is above 15000.Whenever I opposed then they advice me to do this.
So please confirm me the legal obligation of EPF deduction.

if the employee has never been member of epf and currently drawing basic +DA above 15000 pm them it is upto the employee to accept or refuse the membership for EPF, but the employer has to offer the same to all employees, and has to get form 11 signed from employee from both , contributing and refusing
once a person get contributory to EPF, he can not be excluded in any case.

Dear Mr Sanjay, Please follow the practice of obtaining " NEW FORM # 11"-Declaration Form from all Employees duly completed signed both by Employee & Employer.You have to cover/Exclude as per the information available in Declaration Form.Please Peruse the attachment which is self explanatory.
