Dear Seniors,
Our company employees strength is 80
However we are going to layoff 17 workers
. Pls clarify :- in the process of layoff do we need to issue Notice
To concerns workers stating our intention of layoff if yes for how many month.
Also clarify the workers who has not completed the 1 yers service period weather such workers can be layoff or not? And
do we need to execute the agreement of layoff with concerns workers for specific period?

If your organisation is a factory, prevailing industrial dispute/relation act and rules to be checked. Existing MOU with trade unions are also a matter of concern.
If come under shops and establishment act, please ensure that the termination of employees are not in violation of any term in offer/appointment order and standing orders.
In both the cases, it is a very sensitive and emotional matter and suggest to handle with utmost care.

I think your query revolves around the " Lay-off " defined u/s 2(kkk) of the Industrial Disputes Act,1947. Therefore, I would like request you to go through Chapters V-A and V-B of the Act first and revert back if you have got still any doubts.
