PFA Supreme Court order dated 9.3.2017 in which it has been held that once an establishment is covered under any of the excepted category u/s 16 of the PF Act the authorities cannot call upon the establishment to comply with provisions of the Act.
16 part-time employees of the unit were not eligible for benefit under State Contributory PF Scheme governing the rest of the regular employees. Supreme court held that just on this ground exemption status of the unit u/s 16 cannot be withdrawn automatically.
