Hi,
We come across disciplinary action on Workmen on permanent roll.
However can you put light and guidance on What disciplinary action can be taken against an indisciplined Mathadi Worker under Mathadi Act.
Also the process of termination or if any mathadi worker is dismissed for indisciplined behavior claiming reinstatement how should it be dealt with.

1. Issue charge sheet and ask for explanation.
2. Upon receipt of the explanation, if unsatisfied, start a domestic enquiry.
3. Conduct the enquiry by an outsider, an independent person giving full opportunity to the charge sheeted employee to defend himself in view of principle of natural justice.
4. Once enquiry is completed, get the report and findings from the enquiry officer.
5. If the charge is proved, you can propose punishment.
Depending on the gravity of misconduct, the punishment can be proposed. Just make sure that the punishment is proportional to the gravity of misconduct.
