Sir, coverage under ESI Act, 1948 and rules/regulations framed thereunder is on the basis of employment of 10 or more persons. If your factory/establishment is situated in implemented area and employing 10 or more persons, it is already coverable and there is no option with the employer except to make compliance under said Act.

As already you have exceeded 10 employees ESI is mandatory if its under coverable area
For EPF registration you need 20 employees. As its less than 20 employees yes, you can apply for voluntary registration.
