Our lebour contractor is supply workers as per our requirement but for PF&ESIC compliance he is unable to do as cod e no for the same not taken. In this case can we able to pay under our sub code of esic and pf. Is there is any provision in low pl guide.

Another question is we are paying minimum wages as per new circular to the contract worker. While calculation of their pf and esic contribution we made structure as 40% in Basic and 60% in allowance and pf calculated on 40% Basic Amount.
Please guide if it is ok or wrong....

sub code ?? principal employer has to pay statuary contribution on contract workers, if the contractor fails to do so, reg splitting of wages, we shall advise not to split the minimum wages,

Before engaging contractor PE has to ensure that he has obtained registration under PF & ESIC. It is not correct to affect deductions & remit them in your account as it may lead to claim of permanency under PE, that is you.
