Kindly advise me as per below query,
As per new amendment the payment of bonus act 1965 ceiling rate has been changed 7000 & 21000 Rs. So as per the new circular In section 12 of the principal Act,—(i) For the words ‘‘three thousand and five hundred rupees’’ at both the places Where they occur, the words ‘‘seven thousand rupees or the minimum wage for the Scheduled employment, as fixed by the appropriate Government, whichever is higher’ Shall respectively be substituted; if any employee minimum wages below then 7000 thousand just like 6500 Rs per which amount should be considered 7000 Rs or 6500 thousand as per bonus. I just want to get clarification of bonus calculation as per law.

HI MR. GAURAV according to bouns act we consider bouns on 6500.For example, employee minimum wages 7500 then we consider bouns on 7000.(AS FIXXED BY GOVT.)

Sir first of all thanks a lot for your reply but sir what does mean of this sentence The minimum wage for the
scheduled employment, as fixed by the appropriate Government, whichever is higher’’shall respectively be substituted . for example minimum wages fixed by appropriate government 6500 rs but minimum bonus ceiling rate is 7000 rs so higher will be 7000 then it shall respectively be substituted. Please sir clear my point

with regard to your query :- suppose if employee salary is 10K and minimum wages for scheduled employment fixed by appropriate goverment is 6500 then as per sec 12 the ceiling limit of 7000 will be consider for bonus calculation however if minimum wages is more then 7000 say 8000 then minimum wages shall be consider for bonus calculation. if employee salary is less then 7000 say 6000 and minimum wages is 6500 then as per sec 9 & 10 the actual salary shall be consider for bonus calculation i.e. 6000.
pls note sec 12 relates to ceiling limit or minimum wages shall come into picture when drawn salary is exceed the ceiling limit if salary is below ceiling limit in that scenario as per sec 9 & 10 the actual salary shall be taken drown by employee also note that bonus shall be calculate monthy basis and check all the necessary compliance pertain to the act. such as sec 16 weather establishment or company is eligible to disburse the bonus etc?
