I am working as an HR in a hospital which is NABH & NABL certified and wanted to know that is leave of 3 months to the female employee during her pregnancy as per maternity act,1961 applicable to our company also. Or is it for government organisations only. Same with the earned leaves also.We don't provide any EL. Kindly suggest me if providing EL is also compulsory.

The maternity benefit Act 1961 is applicable to every shop and commercial establishments where ten or more than 10 persons are employed or were employed on any day of preceding twelve months.
The maximum period for which any women shall be entitled to maternity benefit shall be twelve weeks of which not more than six weeks shall precede the date of here expected delivery. The leaves with wages are also compulsory for which please go through your state shops and commercial establishment act / rules for more clarification.
