I want to know the procedures and details if a company is going to shut down their process. How many days notification has to be given to employees if they are going to shut down the operations and how many months salary should be paid? If they are not ready to pay what steps the employees can take legally? i need these details urgently..

Dear Swati,
1. Notification depends on the their contracts, what notice period is mentioned in the appointment letter of the employees. Let Suppose if three months mentioned then you should intimates them well in three months.
2. For instance, if you have to immeaditely shutdown your company, you have to pay the salaries for the notice period.
3. If the company is not able to pay the salaries of notice period, employees can take legal action by sending them a letter.

Dear Swati, As per law you have to pay one month notice salary, otherwise employe can challenge you in labour court. After all you have to pay. Rgds/Jitender

Dear sir,
as per company factory act 1948 closing the company owner two month before approval goverment of state . Approval i am closing the company some reason and detail or state approval then he is closed the company other wise not allow the closed the company. Or any case owner shut down the company he is three month salary or 45 days payment mentlly harrasment payment extra or if any notice any employee terminate . And employee writ the labour court before 6 month half salary gross salary paid after 9 month 75 perdcentage or after 9 month full payment of ending the case date or approval increment all yearly as per law.
