Hi All
I have a case in my organization, where an Employee went on maternity leave and never returned back, she neither gave any resignation nor did she come back. Now suddenly after an 7 months she drops a message to get her salary of 3 months(Maternity period). Should we do that. If not done can she file a case against us

You should have sent her a notice when she failed to come back after maternity leave.
However now send her a notice asking her to come back and face proceeding for illegal absence or produce verifiable evidence of illness etc which didn't permit her to join back.
After proceeding,company take action including dismissal.
If she is being dismissed after following procedure,then she will not be entitled for maternity benefits.Procedure is long and time consuming but it is better to follow procedure for regularisation of absence and then decide to pay or not to pay.

If she have had submitted the maternity leave and her application was approved then you are liable to pay her maternity leave dues
