Hi I am working in company and I have resigned from my job. I supposed to serve the notice period of 30 days, I am ready to serve the whole notice period. But company is asking me for early relieve and they don\'t want to pay the money for remaining days. I am asking them for money of remaining days, they don\'t want me to serve. As per my appointment letter clause no.9
After confirmation either party can terminate this contract of employment by giving one month's notice or on payment of one month's salary in lieu of one month's notice to the other party.
I have following questions.
1). Whatever they are doing is correct or not?
2). Am I eligible for money of remaining days I am not serving.

Dear Ankit,
Since they are releasing you, yes they must pay you. But then you might need to wrestle it out with them, because they are unwilling. How big is the amount? Is it worth putting up the fight?

Dear Ankit,
You have resigned and given notice of one month but your employer is relieving you early without payment of remaining days of the notice, then he is doing nothing wrong because you have given notice but other party do not want you complete your notice.. Then what wrong he is doing in this? In fact, some times for administrative purposes, this is done.
On the contrary, if employer has given you notice and relieved you early without payment of remaining days, then there was wrong and you must have been paid.
