Would like to get your suggestions as I have resigned from my post and has sent the signed copy of my resignation through email and courier to my superior authority who sits in other state from mine. My notice period is 1 month.
It has already been 18 days since I have resigned but my superior is not providing acknowledgement of acceptance or rejection. When ever I ask for an acknowledgement he confirms he has acknowledged (verbally and not by email). As I am joining a new company, their terms are to provide a copy acceptance of resignation or relieving letter which is mandatory.
Please provide me inputs on few points
1. Shall I consider that my resignation is accepted (please provide me the clause or rule details which talks on this)
2. As per digital security act 2000 is my email considered as accepted if not acknowledged within 3 days of receipt?
3. What document can I provide to new company during joining on relieving?

1. There is no clause on clear rules for resignation. But as per Indian contracts act, your employer cannot stop you from relieving after giving them sufficient time (notice period) to find the replacement for your position.
2. You can produce the resignation email print out.
3. You said, you have couriered the resignation letter. You can produce the acknowledgement copy of the courier. Collect the acknowledgement copy fro your courier service and produce it as an acceptable document.

Thank you mr. Stephen for your input. Also please let me know once after the completion of notice period can I inform the HR and my reporting authority through mail and move out of the company?

Dear Sushruth,
If your respective manager is not accepting your resignation in written then no issue. You have sufficient proof of your resignation acceptance. Just retain the proof/POD details of courier of your resignation for future you couriered to your manager.
Moreover, you can give your manager one more Reminder on your resignation to accept it and keep yours personal Mail Id in BCC or CC.
Hope it will resolve your query or doubt.

Since you have waited for more than 18 days without any reply, it can be presumed that your resignation is accepted provided that the letter of resignation has been delivered properly. It is always advisable to send official letters through registered or speed post apart from email.

There is nothing called digital security act, but if you can check information technology act yourself and find out if there is any provisions.
