Dear Dilip,
Your employee is eligible to apply for leave. What is the court case all about? Is there any charges on him that he is testifying upon? Even if it is, he is not guilty unless proved !
Hence, please treat him as an equal. He is eligible for the number of leave-balances he may have. Beyond that he might have to apply for Leave-Without-Pay.
Hope this answers your question.

dear friend,
attending of a court is for the reason related to personal or for the organisation, in case it is personal then the individual is liable to make arrangement, in case it is on behalf of the organisation it comes under the purviedw of duty on that day, thus, kindly take necessary steps accordingly...
best regards..

Further, if the organisation under the circumstances of enquiry after finalisation taken the individual in the work, however, filed a case for damages, his court attending for the case should be a part of duty, also, if the individual filed a case against the organisation where he/she is serving for work exploitation that should be covered under normal pay and allowances, however, if he/she filed a suit against the organisation for compensation of the place like rent etc., it will become a civil case and the individual is liable to make his/her own arrangement..
thus the reason clubbed with the case is essential for further taking a decision ...

Why is that he attended the court? Is it related to the duties assigned to him?

It is reasonable to grant him leave, either from PL/EL or CL to be accounted from his own leave a/c. However if there is no leave balance one day paid special casual leave can be granted and employee should produce a attendance sheet issued by the court or court summon as a proof.
