Dear Experts,
If some one can attend my question and help me inthis matter.

I joined and left an Indian IT company in Hyderbad within 2 days. I joined the company during May 2012 and left during same month and within 2 days by informing them through my personal Email and explaining my urgency and personal reasons via Phone and email.

During joining there I signed all the contaract of employement letter as per thier norms as per their standard. They are CMM5 level company.

Now, I recived first a letter 'Legal Notice' from lawyer of the company by asking the money for settlement and I responded to them by sending the asked amount via DD by courier. Called via phone and got acknowlegement via phone from them.

Further, I did not keep any track as well no proof of payment I can found as send it through DD and missed the copy of it. Now all of a sudden we recieved a letter of Summon from court and to appear on next 30th Dec which next 7 days to the court in Hyderabad.
I am totally clueless and scared as I have no idea on this matter at all.
I am looking for a help from expert out here.

Best Regards

Go to your bank and got details of DD which you have made.
The DD would have been paid by a cheque of your bank a/c and using all that details can be obtained.
Kindly put the legal notice wordings on the forum(mask names etc) so that legal experts on forum can advice.
Check with courier company details of delivery.
It is not clear what else you were expected to do,if as you state the demanded amount has been paid.
Details need to be given for better understanding.
Most important speak to a local lawyer in your place.

""I did not keep any track as well no proof of payment I can found ""
Very casual on your part and this is what has ut you in a situation of facing legal proceedings.
But what I cannot make out is after payment why has the company gone legal??
Any other terms and conditions which have been breached ??
The case pertains to May 2012 and now matter is going to be legal-why after 3.6 years?
What is the history or cause of legal proceedings being launched so late??

what else, apart from asking for compensation, did the company write in the original notice? The Company has not acknowledged the payment in full and final settlement of their claim is to be noted here. Anyway you should contact the a good lawyer and ask his opinion now that the time available is short. Your payment details will be available with the bank through whom you bought the DD. That can be proved. contact them also for details of clearance of the DD.
When you paid, your intention was good. But the employer seems to be a complicated one. You have also been casual about it in as much as you have not closed the loose ends here. I wish you good luck for your legal battle and also for future.

Try approaching the bank and get the DD details if it was encashed or not, if yes by whom. By showing the summons the Bank Manager should help you..
